General Terms and Conditions for the Arrangement of Equestrian Experiences
Dear Customer,
We are pleased to take care of your travel and riding wishes. We arrange individual tourist services (in particular accommodation, transport services, and nature experiences on horseback).
The contracts for the arranged services (accommodation, transport, excursions, and riding opportunities) are concluded directly between you and the respective service provider. The participation, accommodation, or transport conditions of the respective providers apply; these will be made available to you prior to booking.
We kindly ask you to carefully read the following General Terms and Conditions (“GTC”) for the arrangement of travel services of Untamed Trails by Joanna Buri, Jungfraublickallee 4, 3800 Matten, CH, (“travel intermediary” or “Untamed Trails”). These govern the arrangement of the respective services with regard to the rights and obligations of you as the customer and of Untamed Trails as travel intermediary. The mutual rights and obligations of the customer and the travel intermediary arise from the individually agreed contractual arrangements, these GTC, and the statutory provisions. By using our intermediary services, you agree to these GTC.
Conclusion of Contract, Contractual Basis
By accepting the customer’s brokerage order by the travel intermediary, a contract for the arrangement of individual travel services is concluded between the customer and Untamed Trails.
If the order for arrangement is submitted electronically (e.g. email, website, internet, SMS), Untamed Trails will confirm receipt of the order electronically. This confirmation of receipt does not constitute acceptance of the brokerage order. In particular, it does not constitute acceptance of a travel contract (such as a transport or accommodation contract or a contract for riding experiences) by the arranged service provider. A travel contract is only concluded upon confirmation by the respective provider.
For the rights and obligations of the customer towards the arranged service provider, only the agreements made with that provider apply, in particular its terms and conditions. By booking the arranged individual service, the customer accepts the terms and conditions of the respective provider as made known to them. This also applies to rebooking and cancellation conditions, which are determined solely by the provider. The travel intermediary does not become a contractual party to the customer for the arranged service and assumes no liability for services provided by third parties.
2. Pricing, Payment
The price for the arranged service is determined by the provider. Payment terms are governed by the general terms and conditions or other provisions of the respective provider. Further information, including available payment methods, can be found in the provider’s terms depending on the type of service.
3. General Obligations of the Travel Intermediary, Information, Advice
Based on these brokerage conditions, the customer is advised to the best of their ability. Upon request, Untamed Trails will submit the booking request to the provider. After confirmation by the provider, the intermediary is obliged to hand over the documents relating to the arranged service. This does not apply if it has been agreed that the documents are sent directly to the customer.
When providing information and advice, Untamed Trails is liable within the scope of the law and contractual agreements for the correct selection of information sources and the accurate transmission to the customer, but not for their accuracy, completeness, or timeliness, as these may change at any time.
Special requests are only forwarded by Untamed Trails to the arranged provider. Unless expressly agreed otherwise, Untamed Trails is not responsible for fulfilling such special requests. These are also not a condition or basis of the brokerage order or of the customer’s booking declaration to be transmitted to the provider. The customer is informed that special requests generally only become part of the contractual obligations of the provider upon express confirmation by the provider.
4. Complaints by the Customer
Claims and complaints must be asserted directly against the provider. Any deadlines must also be observed when claims are made; these are not preserved by submission to Untamed Trails.
Untamed Trails has neither the right nor the obligation to advise on the type, scope, amount, prerequisites, deadlines, or other legal aspects of any claims the customer may have against the provider.
5. Remuneration Claims of the Travel Intermediary
The prices stated for the services are prices of the arranged provider. The providers are paid directly by the customer.
However, the customer undertakes, upon first request, to provide a credit card guarantee for booked services.
Any service fees payable by the customer to Untamed Trails in connection with consultation, booking, cancellation, rebooking, or other services are set out in the agreed service fee arrangements communicated to the customer.
Any commission income from providers belongs to Untamed Trails.
Untamed Trails’ entitlement to service fees remains valid in the event of disruptions or changes, in particular rebooking, withdrawal, cancellation, termination, or cancellation of the arranged services by the provider or the customer.
6. Reimbursement of Expenses, Fees, Collection
The travel intermediary is entitled to request payments in accordance with the service and payment terms of the arranged provider, provided these are validly agreed between the provider and the customer.
The travel intermediary may assert payment claims as the provider’s collection agent or on its own behalf based on the customer’s advance payment obligation.
These provisions also apply to cancellation or rebooking costs and other legally or contractually based claims of the provider.
The customer may not offset or withhold payments due to claims against the provider.
7. Travel Documents, Other Contractual Documents
The customer must check all documents received from the provider (especially booking confirmations and vouchers) for accuracy and completeness.
If documents are not sent directly by the provider, they will be delivered by the travel intermediary either by post or electronically at its discretion.
8. Customer’s Duty to Cooperate
The customer must immediately report any recognisable errors or defects in the intermediary’s services.
This includes incorrect or incomplete personal data, information, or documents, as well as incomplete performance of intermediary services.
The customer must check documents immediately upon receipt. Any discrepancies, especially regarding identity data, must be reported immediately.
Providers may refuse services if names do not match travel documents.
Untamed Trails accepts no liability for delays or issues resulting from failure to report discrepancies.
Customers are encouraged to inform the provider or intermediary of special needs or limitations.
9. Entry Requirements
The customer is responsible for compliance with passport, visa, customs, currency, and vaccination requirements.
Entry requirements may change at short notice. The customer bears full responsibility for compliance.
All cancellation and additional costs arising from entry requirements are borne by the customer.
10. Insurance
Travel insurance (cancellation and travel incident insurance) is strongly recommended.
The customer must ensure adequate insurance coverage for accidents, especially riding accidents, and illness abroad.
11. Liability of the Travel Intermediary
Untamed Trails is not liable for defects or damages arising in connection with the arranged services.
Any liability arising from culpable breach of intermediary duties remains unaffected but is limited to the extent permitted by law.
Untamed Trails is only liable for intentional or grossly negligent conduct. Liability for slight negligence and indirect or consequential damages is excluded. Liability for auxiliary persons is also excluded.
12. Force Majeure
If services cannot be provided due to force majeure (e.g. natural disasters, terrorism, war, epidemics/pandemics, communication failures, strikes, governmental measures), the consequences agreed between customer and provider apply.
13. Data Protection
In connection with the arrangement of travel services, the following data may be stored: contact details, travel data, destinations, accommodation, price, customer preferences, other travellers, payment information, date of birth, nationality, language, and other provided information.
14. Applicable Law and Jurisdiction
Swiss law applies exclusively, excluding conflict-of-law rules and the UN Sales Convention (CISG).
Subject to mandatory law, the courts at the registered office of Untamed Trails have exclusive jurisdiction.
15. Miscellaneous
Untamed Trails may amend these GTC at any time. The current version is published on the website or otherwise communicated to the customer.
If any provision is invalid, the remaining provisions remain unaffected.
